THIS IS A LEGAL AND BINDING AGREEMENT BETWEEN YOU AND KAPPLEMULTIMEDIA.COM and SUPERSTOCK, RELATING TO THE USE OF KAPPLEMULTIMEDIA.COM and SUPERSTOCK'S WEB SITE, DOWNLOADING OF IMAGE FILES FROM SUCH WEB SITE, AND THE LICENSING OF IMAGES BY SUPERSTOCK TO YOU.

When you download image files from this web site, or receive image files from Kapple Multimedia through any other means, or receive images from Kapple Multimedia via film or any other medium, you agree to and accept all the terms of this Agreement.

If your actions are on behalf of your employer or another third party, then all the terms and conditions of this Agreement apply to you and your employer or other third party.

Images are not to be used in any manner without expressed permission from Kapple Multimedia. All images are licensed under the terms and conditions as specified at time of purchase. No image licenses are valid until Kapple Multimedia has received payment in full. Image usage without prior payment and Kapple Multimedia's express written authorization is a copyright violation. All rights not specifically granted are retained by Kapple Multimedia.

Images are not sold; their use is licensed and they remain the sole and exclusive property of Kapple Multimedia.

Images or image files cannot be distributed or re-sold independent from a product and may not be used in a manner allowing permanent storage or re-use by third parties. No licenses may be sublicensed, transferred or assigned. You agree not to make, authorize, or permit any use of any image except as specifically set forth here and on the invoice you will receive.

Failure to comply with any of the provisions of this Agreement may result in immediate revocation of the license granted.

For all other use, licensing is required. All photos are the copyrighted works of Keith Kapple and Superstock.com and have been registered with the U.S. Copyright Office. As a result, copyright infringements can and will be prosecuted to seek statutory damages (of up to $150,000 USD per infringement) plus legal fees. In addition, such infringements may be ruled criminal offenses under the Digital Millennium Copyright Act.

Q: How will the image be delivered to me?
A: For purchasers of image licenses, you will receive an email with details on how to download your images after your order is processed. Although this usually only takes a few hours, it is possible that the process may take up to 5 days depending on my travel schedule and if I have an assistant available. Fine art prints are custom printed so please allow 1-3 weeks for delivery. Prints are made on glossy paper. If your purchase is urgent, feel free to send an email to kapplemultimedia@gmail.com to check turnaround time.

Q: I have a custom request, can you accommodate me?
A: If you would like your digital file on CD instead of a download, your fine art prints on matte/canvas paper instead of glossy paper, or have any other custom request, feel free to submit your request to kapplemultimedia@gmail.com and I will try my best to accommodate it.
